GolfNow 2008 Rewards Program - Terms & Conditions

1. These GolfNow Rewards Program Terms and Conditions are effective January 1, 2008 and supersede any previously issued terms and conditions. The GolfNow Rewards Program shall terminate on December 31, 2008.

2. The GolfNow Rewards Program Terms and Conditions may be changed, at any time and without notice, by GolfNow, Inc. The GolfNow Rewards Program may be terminated, at any time and without notice, by GolfNow, Inc. in its sole discretion. All rewards associated with the GolfNow Rewards Program are subject to availability.

3. The participating GolfNow community websites ("Participating Community Sites") are subject to change or termination at any time and without notice, by GolfNow, Inc. The GolfNow Participating Community Sites include:

4. A GolfNow user (a “User”) shall be eligible to receive one (1) free round of golf for every five (5) eligible bookings made by such User on any Participating Community Site. A booking made on any Participating Community Site between January 1, 2008 and December 31, 2008 shall qualify as an “eligible booking”. Bookings that are made and subsequently cancelled will not be counted as eligible booking.

5. A free round of golf, earned by a User, must be redeemed within six (6) months of the issue date on a Participating Community Site. The “issue date” shall be the date on which the tenth (10th) eligible booking is made. The availability of free rounds may be limited from time to time and is not guaranteed. Not all tee times are available for free round bookings. Users must select and book free rounds online using the Redeem Free Round page.

6. The GOLF MAGAZINE offer is provided by Time, Inc. A Time Warner Company and subject to change or termination at any time and without notice by GolfNow, Inc. A one year subscription to GOLF MAGAZINE (12 issues valued at $19.95) is included with your second booking. This is a refundable offer. Instructions will be mailed to you at the address provided on your account. The GOLF MAGAZINE offer is valid in US and Canada only.

7. The Upswing golf club offers are provided by Upswing Golf, Inc. and subject to change or termination at any time and without notice by GolfNow, Inc. Redemption instructions will be emailed to the email address provided on your account. Golf club selection and availability are not guaranteed. Performance fitting fee along with shipping and handling fees are the responsibility of the User and range from $19.95 to $49.95. US shipping address required.

8. Eligible bookings associated with a User’s account do not constitute property of the User, have no cash or monetary value and cannot be transferred by operation of law or otherwise. Except as otherwise specifically stated in these Terms and Conditions, eligible bookings or free rounds earned are not transferable to other programs administered by GolfNow, Inc. or its affiliates. Accounts can only be assigned to one individual; no joint accounts will be permitted. In the event of the death of a User, their eligible bookings are not transferable and cannot be given to survivors or beneficiaries.

9. Fraud or abuse occurring in connection with the GolfNow Rewards Program is subject to appropriate administrative and/or legal action by GolfNow, Inc. This includes, but is not limited to, the forfeiture of all accrued eligible bookings made with a User’s account, cancellation of any award previously issued and/or termination of the User’s participation in the GolfNow Rewards Program.

10. All questions or disputes involving the interpretation or application of these Terms and Conditions will be decided by GolfNow, Inc. in its sole discretion.

11. The GolfNow Rewards Program is void where prohibited by law.

12. Acceptance of a free round constitutes permission (except where prohibited) for GolfNow, Inc. to use the participant’s name, likeness, biography, statements, and any other similar materials for marketing, promotional and publicity purposes without additional compensation to the participant or any limitation. Participants may be contacted by GolfNow, Inc. with future promotional offers. Information provided by a participant in the GolfNow Rewards Program is subject to GolfNow, Inc.’s privacy policies.
